Crushing Defeat

Just a quick post to keep you jackals at bay!

What is a jackal, anyway? I don't think I really even know what that is.

So, the Supreme Court apparently thinks it's unconstitutional to prohibit the making and selling of videos that depict dogfighting and the crushing of small animals as a source of sexual pleasure.

Uh...huh?

What the fuck is going on over there? Those guys have lost their goddamn minds. Obama should just pack the fuckin court. Ok, maybe that's a bit extreme. But they're nutjobs!

I think you're mad at the wrong branch of government. If the legislature, you know, actually focused on understanding their legislation there’s a better chance their shoddy workmanship wouldn’t fall apart at the slightest challenge. I really can’t wait for that brain trust to pass a law removing arsenic from the periodic table because it’s a poison. Ironically the target of Obama’s only filibuster against a nominee was the only dissenting vote.

Anonymous - I agree with your reason for why the majority ruled the way they did. The legislation was too broadly written. Narrower legislation, actually focused on stomping animals for sexual gratification, would unquestionably have withstood constitutional scrutiny.

Your last statement, however, is ridiculous. Alito was filibustered because he's a conservative, Reagan-ite, twat. Any sane liberal would have done anything possible to keep him off the court. Further, there's not even any irony there. Liberals and conservatives alike want legislation written so that it focuses on what it is supposed to focus on.

Your last point completely goes against your first. If it's the legislature's fault (which it was), and the Court was merely instructing them to fix their statute (which they did), then alluding that Alito's dissent is evidence of Obama's inability to see a good judge is, frankly, stupid.

It's not even that I minded Alito's dissent, but for it to serve as some ridiculous misguided rallying cry is preposterous.
